Predatory Servicing & Foreclosures

What is a Predatory Servicing?

Predatory Servicing is a term used to describe abusive, unfair, deceptive, or fraudulent mortgage servicing practices of some mortgage servicers during the mortgage servicing process.

The general accepted consensus is that predatory servicing exists wherever the Servicer is making money off the borrower in unscrupulous and often unknown fees. These fees can and will put the borrower on the road to foreclosure.

Think about this: The Banks are busy cleaning up the mess they made at your expense. Many people who are foreclosed upon were first lied to, their loan mods stalled, lost, or forgotten. While the Banks were busy seemingly mucking things up on your loan modification process, they were not missing a beat on your foreclosure.

What is a Predatory Foreclosure?
Potentially any type of foreclosure proceeding that is begun because of the actions of lenders in marking up your bill, suspending your payments, and then being able to start listing your payments as late.

Signs of Predatory Servicing

Providing often unknown or even unwanted services for a fee which they have marked up for their own profit

Stalling loan mods to the point that your balance is too high to be able to modify,

Paying your escrows and then putting your payments in suspense or back to your escrows, etc.
